1. Acceptance of terms
By accessing or using Funerl (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms form a legally binding agreement between you and Funerl, Inc. ("Funerl," "we," "us").
We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. We will notify registered users by email of any material changes at least 14 days in advance.
2. What Funerl is — and is not
Funerl is an online marketplace that connects individuals seeking private venues for celebrations of life and similar gatherings ("Guests") with property owners and operators who list their spaces ("Hosts"). Funerl is not a venue operator, event organizer, property manager, insurer, or co-host of any gathering.
Funerl does not own, control, offer, or manage any listing. We do not verify that listings comply with local laws or zoning requirements. We do not supervise, oversee, or participate in any booking or gathering.
Any agreement for the use of a venue is solely between the Guest and the Host. Funerl is not a party to that agreement.
3. Eligibility
You must be at least 18 years old to create an account or use the Platform. By using Funerl, you represent that you meet this requirement and that all information you provide is accurate and complete.
4. Accounts
You are responsible for maintaining the security of your account credentials. You must notify us immediately at hello@funerl.com if you suspect unauthorized access to your account.
You may not create accounts on behalf of others, impersonate any person, or use false information. We reserve the right to suspend or terminate accounts that violate these Terms.
5. Host responsibilities
By listing a property, you represent and warrant that:
- You have the legal right to list and rent the property (as owner, lessee, or authorized agent)
- The listing complies with all applicable local laws, zoning ordinances, HOA rules, and lease agreements
- You will maintain the property in safe, clean, and accurately described condition
- You carry adequate insurance covering gatherings of the size and type you accept
- You will honor confirmed bookings except in genuine emergencies
Funerl is not responsible for any Host misrepresentation, property defects, legal non-compliance, or failure to perform. Hosts bear sole liability for their listings and the gatherings held at them.
6. Guest responsibilities
By making a booking, you agree to:
- Use the venue only for the purpose, date, time, and guest count described in your booking
- Follow all Host rules communicated before or at the time of booking
- Leave the venue in the same condition in which you found it
- Comply with all applicable laws, including fire codes and noise ordinances
- Take responsibility for the conduct of all attendees at your gathering
7. Bookings and cancellations
Instant book listings are confirmed immediately upon submission. Request listings are not confirmed until the Host accepts.
Cancellation terms are set by individual Hosts and displayed on each listing. Funerl does not guarantee any refund for cancellations. Disputes between Guests and Hosts are to be resolved directly between the parties; Funerl may assist in good faith but has no obligation to do so.
Payment processing is handled by third-party providers. Funerl is not responsible for payment processor errors, delays, or failures.
8. Prohibited uses
You may not use the Platform to:
- List or book venues for illegal activities
- Engage in fraud, misrepresentation, or deception
- Harass, threaten, or harm other users
- Scrape, copy, or reproduce Platform content without permission
- Circumvent the Platform by completing transactions off-platform to avoid fees
- Post false, misleading, or defamatory reviews
9. Reviews
Reviews must be honest, based on your direct experience, and not contain defamatory, discriminatory, or irrelevant content. We reserve the right to remove reviews that violate these guidelines. We do not otherwise edit review content.
10. Intellectual property
The Funerl name, logo, design, and Platform code are owned by Funerl, Inc. and protected by copyright and trademark law. You may not reproduce or use them without our written permission.
By submitting content (photos, listing descriptions, reviews), you grant Funerl a non-exclusive, royalty-free, worldwide license to display and use that content to operate the Platform.
11. Disclaimer of warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FUNERL DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
FUNERL MAKES NO WARRANTY REGARDING THE ACCURACY, QUALITY, SAFETY, LEGALITY, OR AVAILABILITY OF ANY LISTING.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FUNERL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, ANY BOOKING, OR ANY GATHERING, EVEN IF FUNERL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
FUNERL'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT OF FEES PAID BY YOU TO FUNERL IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
13. Indemnification
You agree to indemnify, defend, and hold harmless Funerl, its officers, directors, employees, and agents from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising from your use of the Platform, your listing or booking, any gathering you host or attend, your violation of these Terms, or your violation of any third-party rights.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute that cannot be resolved informally shall be submitted to binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules. You waive the right to participate in a class action lawsuit or class-wide arbitration.
